Art. 1 — Premises

The present conditions govern the use and registration to the website https://foilingweek.com (and its subdomains) jointly operated by Associazione Culturale Sportiva TFW and We Are Foiling — Corso di Porta Romana, 63 – 20122 Milan – Italy.

This document clarifies which entity is the contracting party for specific services. General use of the Site, access to free content, and participation in non-commercial community activities are governed by the terms applicable to the Associazione. All commercial activities, including e-commerce purchases and paid event/clinic bookings, constitute a contract with We Are Foiling S.r.l.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately. These Terms should be read alongside the Privacy & Cookie Policy, which is incorporated herein by reference.

Art. 2 — Definitions

Terms / Conditions of Use and Registration to the Site: These conditions of use and registration to the Site.
We Are Foiling: The collective brand name for the activities operated
Associazione Culturale Sportiva TFW: Associazione Culturale Sportiva TFW – Corso di Porta Romana, 63 – 20122 Milan – Italy. The entity governing general use of the Site, non-commercial services and acting as the contracting party for all commercial services, including e-commerce and paid event bookings.
Services: The services offered to registered and non-registered Users of the Site, including event information, registration management, performance clinics, media access, and future e-commerce functionality.
Site / Application: The Internet portal accessible at https://foilingweek.com and its subdomains…
Users: Registered and non-registered visitors to the Site.
Consumer: A User who is a natural person acting for purposes outside their trade, business, craft, or profession.
Order: A request made by a User to purchase products or services from the S.r.l. through the Site’s e-commerce functionality (future functionality).

Art. 3 — Use of this site

3.1. The User undertakes to use the Site and the Services in a lawful and fair manner, in compliance with all applicable legal provisions and with these Conditions of Use.

3.2. Unless otherwise stated for specific Services (such as e-commerce purchases or event registrations for professional participants), the User undertakes to use the Site only for personal purposes and not for commercial, business, or professional purposes.

3.3. The User also undertakes not to:

Use software programs or other automatic or manual mechanisms to copy (including through framing or redirect procedures) the web pages of the Site or their contents
Copy, reproduce, alter, modify, or disclose the contents of the Site without prior written authorisation from Foiling Week
Use any mechanism, software, or procedure that may interfere with the proper functioning of the Site
Transmit unsolicited commercial communications (spam) or introduce viruses, malware, or any other harmful code
Attempt to gain unauthorised access to any part of the Site or its underlying systems
Use automated tools (bots, crawlers, scrapers) without prior written consent
Engage in any conduct that is fraudulent, misleading, deceptive, defamatory, or offensive, or that infringes any third-party rights

Art. 4 — Intellectual Property Rights

4.1 — User-generated content: The User retains full ownership and copyright of their submitted content (e.g., photographs, testimonials, social media posts tagged to our events). By submitting content, the User grants Foiling Week a worldwide, royalty-free, non-exclusive licence to use, reproduce, adapt, publish, and display such content for the specific and limited purpose of promoting Foiling Week and its related events across all media channels. The User may revoke this licence for future use at any time by providing a written request to info@wearefoiling.com.

Art. 5 – Event Registration and Participation

5.1 Race Entries – Race entries for Foiling Week events are managed through official event registration systems (e.g., Fraglia Vela Malcesine’s platform). By registering, you agree to the specific Notice of Race and Sailing Instructions published for each event, which shall take precedence over these Terms with respect to on-water racing matters.

5.2 Performance Clinics and Workshops – Bookings for performance clinics and workshops (including those made via the Jotform booking form on the Website) are subject to availability and payment of applicable fees. Confirmation is contingent on receipt of full payment.

5.3 Cancellation and Refund Policy for Events – Cancellation and Refund Policy may change at each event and it is indicated in the relative Notice of Race. If FoilingWeek cancels or postpones an event due to circumstances beyond its control (force majeure), a credit for a future event or a full refund will be offered at Foiling Week’s discretion

5.4 Assumption of Risk and Safety – Foiling is an inherently risky sport. By registering for and participating in any Foiling Week event, you acknowledge and voluntarily accept the inherent risks associated with foiling, sailing, and water sports, including the risk of personal injury, property damage, or death.

You confirm that:

You have adequate sailing experience and physical fitness for the event you are entering
Your equipment meets the class rules and safety requirements specified in the event regulations
You hold adequate personal accident and third-party liability insurance
You will comply with all safety briefings, notices, and instructions from race officials

Art. 6 — E-Commerce — Purchase of Products and Services

The following provisions apply when e-commerce functionality is available on the Site. All purchases constitute a contract with We Are Foiling and Associazione TFW.

6.1 Product Listings – FoilingWeek makes every effort to ensure that product descriptions, images, and prices are accurate. However, errors may occur. Foiling Week reserves the right to correct any errors and to refuse or cancel orders placed based on inaccurate information, and is not bound to honour an order placed at an incorrect price.

6.2 Ordering Process – By placing an order through the Site, the User makes an offer to purchase the product or service at the stated price. The order constitutes a binding contract only upon Foiling Week sending an order confirmation email. Foiling Week reserves the right to decline any order at its discretion.

6.3 Prices and Taxes

All prices are displayed in Euros (EUR) unless otherwise stated
Prices are inclusive of applicable VAT (IVA) where required by Italian law
Foiling Week is not responsible for customs duties, import taxes, or additional charges applicable to international orders

6.4 Payment – Payment is accepted via the methods displayed at checkout (which may include major credit/debit cards and digital wallets). All payment transactions are processed by PCI-DSS-compliant third-party payment processors. Foiling Week does not store full payment card details.

6.5 Right of Withdrawal (Consumer Rights) – In accordance with the EU Consumer Rights Directive (2011/83/EU) and Italian Legislative Decree 206/2005 (Codice del Consumo), Consumers have the right to withdraw from a distance purchase contract within 14 days of receiving the order, without stating any reason.

To exercise the right of withdrawal, the Consumer must notify We Are Foiling or the Associazione TFW within 14 days of receipt of the goods by sending a clear written statement (e.g., by email to info@wearefoiling.com). Goods must be returned within 14 days of notifying We Are Foiling or the Associazione TFW of the withdrawal, unused, in their original packaging, and in resalable condition. Return shipping costs are borne by the Consumer unless goods are defective or incorrectly supplied.

We Are Foiling will refund the purchase price (including standard delivery charges, but not the additional costs of expedited shipping) within 14 days of receiving the request of withdrawn. A model withdrawal form, as provided for by the Italian Consumer Code, will be made available to the Consumer to facilitate the exercise of this right. This information will also be clearly presented during the checkout process before the order is finalised.

6.6 Right of Cancelation from Foiling Week – Foiling Week reserves the right to cancel any booked experience, clinic, workshop, or activity if the minimum number of participants required for the activity to take place is not reached. In such cases, Foiling Week may cancel the activity up to 7 (seven) days prior to the scheduled start date. Foiling Week also reserves the right to cancel, postpone, interrupt, or modify any experience up to 48 (forty-eight) hours prior to the scheduled activity, or at any time if necessary, due to adverse weather conditions, unsafe operating conditions, force majeure, or any circumstance that may compromise the safety of participants, staff, or equipment.

In the event of cancellation by Foiling Week under this Article, participants will be offered, at Foiling Week’s discretion: participation in an alternative session or equivalent activity, subject to availability; a voucher/credit for a future Foiling Week activity; or a full refund of the amount paid for the cancelled experience.

Foiling Week shall not be liable for any additional costs incurred by participants, including but not limited to travel, accommodation, or other indirect expenses related to the cancellation or modification of an activity.

Art. 7 — Communications

7.1 — Any communications to the User will be sent by Foiling Week (and by parties appointed by Foiling Week) to the email address indicated by the User in the Purchase process.

Art. 8 — Disclaimer of Guarantee and Limitation of Liability

8.1 — The Site is offered ‘as is’, in the state of fact and law in which it is found. Foiling Week does not guarantee and makes no representations about the accuracy, reliability, or completeness of the Site and the Services.

8.2 — Access to and use of the Site and Services is under the sole responsibility and control of the User. Subject to the mandatory limits of the law, Foiling Week cannot be held liable for any damage caused by the use or non-use of the Site.

8.3 — Foiling Week does not guarantee in any way to the User that access to and use of the Site and Services will be continuous and uninterrupted, secure, and error-free.

8.4 — Except in cases of willful misconduct or gross negligence, FoilingWeek shall not be liable for any damages arising out of or in any way connected with the use or inability to use the Site and/or Services. FoilingWeek, in particular, cannot be held liable in the event of malfunctioning of the Site, including in the event of suspension and/or interruption of the Services, whether due to technical problems, force majeure or supervening impossibility, including in the case of fraudulent acts carried out by third parties.

8.5 — Foiling Week cannot be held responsible in any way for the content of the websites accessible through the links described in Art. 8.3.

8.6 — Nothing in these Terms excludes or limits Foiling Week’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable mandatory law.

Art. 9 — Force Majeure

Foiling Week shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, government action, labour disputes, failure of third-party infrastructure, or extreme weather conditions. Foiling Week will notify Users as soon as reasonably practicable of any such event and of its anticipated response.

Art. 10 — Modifications to These Terms

Foiling Week reserves the right to modify these Terms at any time. Material changes will be notified via a prominent notice on the Site and/or by email. The ‘Last Updated’ date at the top of this document will be revised accordingly. Continued use of the Site after notice of changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of the Site.

Art. 11 — Severability and Entire Agreement

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if it cannot be so modified, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy & Cookie Policy and any specific event regulations or booking confirmations, constitute the entire agreement between the User and FoilingWeek with respect to use of the Site.

Art. 12 — Applicable Law and Competent Court

12.1 — These Conditions, their application, and the activities connected with Purchase on the Site are governed by Italian law.

12.2 — The exclusive place of jurisdiction for any dispute relating to these Conditions, registration, and use of the Site is Milan (Tribunale di Milano), without prejudice to mandatory consumer protection provisions. For Consumers resident in other EU member states, this choice of jurisdiction does not prevent them from bringing proceedings in the courts of their place of residence, as provided by applicable EU regulations on jurisdiction.

12.3 — EU consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes with online traders.
